Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and the developer of AFib Companion. Please read them carefully before using the app.

By downloading, installing, subscribing to, or using AFib Companion, you agree to these Terms. If you do not agree, do not use the app.

Before anything else: this app is not a doctor

The full medical disclaimer is in Section 3 and it applies to everything in the app.

1. Acceptance of these Terms

By downloading, installing, subscribing to, or using AFib Companion (the “app”), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

If you are using the app on behalf of someone else — for example, helping a family member track their episodes — you confirm that you have their permission to do so and that they also agree to these Terms.

These Terms work alongside the Privacy Policy, which explains what information the app collects and where it is stored. The Privacy Policy is part of this agreement.

2. What AFib Companion is

AFib Companion is an iPhone app for keeping a personal record of life with atrial fibrillation. It is built and run by one independent developer trading as BGW in Nature — not by a company, a hospital, or a medical practice. In these Terms, “we,” “us,” and “our” mean that developer. The app is listed on the App Store as “My AFib Companion.”

The app lets you:

• Log AFib episodes you experience, including start and end times, symptoms, severity, suspected triggers, and your own notes.
• Keep track of your medications, dosing schedules, reminders, and whether you took a dose.
• Read health metrics you have already recorded in Apple Health — heart rate, resting heart rate, heart rate variability, ECG results, AFib History, sleep, and steps — and show them alongside what you have logged.
• Record daily check-ins covering mood, alcohol, caffeine, sleep, stress, exercise, and hydration.
• Generate a summary report as a PDF that you can bring to an appointment, and export everything you have logged as a CSV file.
• See summaries of your own logged data, including patterns between your logged triggers and your logged episodes, and how consistently you recorded taking your medication.
• Keep an emergency card with the information you choose to put on it, and read educational material, including a CHA2DS2-VASc calculator provided for education only.
• Use home screen widgets and lock the app behind Face ID or Touch ID.

What the app does not do. It does not measure your heart rhythm, watch for episodes, alert you to an episode, evaluate your condition, or tell you what to do about any of it. Everything it shows you is a rearrangement of information you entered yourself or that your Apple devices already recorded. The summaries it produces describe your own logged history; they are not findings, not assessments, and not advice.

Reminders are a convenience, not a safety system. Medication and check-in reminders are ordinary iPhone notifications. They can be delayed, silenced, or missed entirely — by Focus modes, notification settings, a device that is off or out of battery, or a software fault. Do not rely on the app to make sure you take your medication. Keep whatever system you and your clinician already trust.

The app is subscription-only. New users get a 30-day free trial with access to every feature. After the trial ends, an active paid subscription is required to keep using the app. There is no free tier. See Section 5.

3. Medical disclaimer

Read this section. It is the most important part of these Terms.

The app does not provide medical advice. Everything it shows you — summaries, patterns, correlations, trends, adherence figures, calculator output, educational content — is for general information only. None of it is a diagnosis, a clinical finding, a recommendation, or a substitute for professional judgment.

Always talk to a qualified healthcare provider before making any decision about your health, your medications, or your treatment. Never stop, start, or change a medication because of something you saw in this app. Never disregard professional medical advice, and never delay seeking it, because of information this app showed you.

The CHA2DS2-VASc calculator is educational only. It reproduces a published scoring system so that you can understand a term your clinician may use. It is not a risk assessment, it does not evaluate you, and it does not replace clinical evaluation. Its output means nothing on its own and should only ever be discussed with your own doctor.

Consumer devices are not medical instruments. Heart rate, HRV, ECG, and AFib History readings from an Apple Watch or iPhone are recorded by Apple’s hardware and software, not by us. They may be incomplete, delayed, or inaccurate, and they are not equivalent to medical-grade monitoring. We do not verify them.

What you log is what you get. The summaries and correlations the app produces are built from data you typed in and from readings your device supplied. If either is incomplete or wrong, the output will be too. An apparent pattern in the app is not evidence of a real relationship in your body.

General wellness product. AFib Companion is offered as a general wellness product under the U.S. Food and Drug Administration’s guidance General Wellness: Policy for Low Risk Devices. It is intended to help you maintain a record of your own health information and general lifestyle habits. It is not intended to diagnose, cure, mitigate, prevent, or treat a disease or condition, and it has not been reviewed, cleared, or approved by the FDA.

By using AFib Companion, you acknowledge that you have read and understood this disclaimer, that the app is not a substitute for professional medical care, and that you will consult qualified healthcare providers for medical decisions.

4. Your account and the 17+ age requirement

To use AFib Companion you must create an account, using either Sign in with Apple or an email address and password. Accounts are handled through Supabase Auth.

You must be at least 17 years old to create an account and use the app. By creating an account, you confirm that you are 17 or older. The app is not intended for children, and we do not knowingly collect information from anyone under 17. If you believe a child under 17 has created an account, email [email protected] and it will be deleted.

You are responsible for:

• Keeping your account credentials confidential.
• Everything that happens under your account.
• Giving accurate information when you register, and keeping it current.
• Telling us promptly at [email protected] if you believe someone else has accessed your account.

One account is for one person. Do not share your account, and do not create an account for someone else without their knowledge and consent.

We may suspend or close your account if we reasonably believe you have broken these Terms.

5. Subscription, billing, and cancellation

AFib Companion is sold as an auto-renewing subscription through Apple’s App Store. There is no free tier and no one-time purchase option.

5.1 Free trial

New subscribers get a 30-day free trial with access to every feature. The trial is offered once per Apple Account, per subscription group — if you have used it before, reinstalling the app will not give you another one, and the app will tell you so before you buy.

If you do not cancel at least 24 hours before the trial ends, the trial converts automatically into a paid subscription and your Apple Account is charged at the price shown when you signed up. Cancelling during the trial, at least 24 hours before it ends, means you are not charged at all.

5.2 Price

Prices are in U.S. dollars. In other regions Apple converts and lists a local price, and tax may be added. The price shown by the App Store at the moment you confirm your purchase is the price that governs — if it ever differs from the figures above, the App Store’s figure is correct and you should not complete the purchase until you are happy with it.

5.3 Billing and auto-renewal

• Apple processes all payments. Your subscription is billed to your Apple Account. We never see, receive, or store your card number or payment details.
• Payment is charged when you confirm the purchase, or, if you started with a free trial, when the trial ends.
• Subscriptions renew automatically. Apple charges your Apple Account for the next period within the 24 hours before the current period ends, and does so at each renewal until you cancel.
• Your subscription continues to renew unless you cancel it at least 24 hours before the end of the current period.

5.4 Cancelling

You can cancel at any time, and you do not need to ask us. Cancel through your Apple Account:

• On your iPhone: Settings → [your name] → Subscriptions → My AFib Companion → Cancel Subscription, or
• At apps.apple.com/account/subscriptions.

The app links to the same place from its subscription screen. To avoid being charged for the next period, cancel at least 24 hours before the current period ends.

Cancelling stops future renewals. It does not end your current period early — you keep access until the period you have already paid for runs out, and access ends then.

Deleting the app from your iPhone does not cancel your subscription. Deleting your account inside the app does not cancel your subscription either. You must cancel through Apple.

5.5 Refunds

No refunds are given for partial periods. If you cancel partway through a month or a year, you keep access until the end of that period, and the unused portion is not refunded or prorated.

Apple handles refunds, not us. Apple is the seller of record for every subscription. We cannot issue, approve, or deny a refund, and we have no visibility into your payment. All refund requests go to Apple at reportaproblem.apple.com, and Apple decides them under its own policies. If a refund would help you, ask Apple — that is not us brushing you off, it is genuinely the only route that exists.

If you are having trouble with the app itself, please do email [email protected]. Problems that can be fixed, we would rather fix.

5.6 Price changes and changes to the plans

We may change subscription prices or the plans on offer. Any price increase will be communicated in advance through Apple, and where Apple requires it, your subscription will not renew at the higher price unless you agree. You can always cancel before a new price takes effect.

5.7 Restoring a purchase

If you get a new iPhone, reinstall the app, or hit a connection problem, use Restore Purchases on the subscription screen to reattach your existing subscription to your account. You will not be asked to pay twice.

5.8 Existing users from before the app became subscription-only

People who were already using AFib Companion before it moved to a subscription received a one-time 30-day access window so they would not be locked out of their own records without warning. That window was a courtesy, applied once, and once it has elapsed a subscription is required like everyone else. Data logged during that window is retained exactly as described in Section 6.

6. Your data, and what happens if your subscription lapses

6.1 Your data belongs to you

You own everything you put into the app — episodes, symptoms, triggers, medications, check-ins, notes, profile details. By using the app you give us permission to store and process that information for one purpose only: running the app for you. That permission ends when you delete your data.

You are responsible for the accuracy of what you enter. We are not liable for consequences that follow from inaccurate or incomplete entries.

Where your information is stored, who processes it, and what stays on your device is set out in the Privacy Policy. In short: your records sync to a private, encrypted account on our backend so they survive a lost phone and follow you to a new one, and the summaries and correlations are generated on your iPhone itself. We do not sell data, we run no advertising, and there are no analytics or tracking SDKs in the app.

6.2 If your trial or subscription ends

Your data is not deleted. When a trial or a paid subscription ends, the app locks and its features stop working — but your records stay on our servers exactly as you left them.

• Resubscribe and everything comes back. Your full history is there, unchanged, the moment your subscription is active again.
• You can still export everything. The CSV export stays reachable from the locked screen. Subscription or no subscription, you can get your own data out at any time.
• You can still delete everything. Account deletion also stays reachable from the locked screen.

Being unable to pay should never mean being locked away from your own health records. That is deliberate, and it is not going to change.

6.3 Deleting your account

You can delete your account and all associated data from inside the app at any time, including while unsubscribed. Deletion is permanent and cannot be undone. Removal timelines are described in the Privacy Policy, and step-by-step instructions are on the Delete Account page.

Two things deletion does not touch:

• Your Apple Health data. That belongs to Apple Health and stays there. Manage it in the Health app.
• Your App Store subscription. Cancel that separately through Apple — see Section 5.4.

Please export a CSV before you delete, if you want to keep a copy. We cannot recover deleted data for you afterwards.

7. Acceptable use

Use AFib Companion for your own personal, non-commercial health record-keeping. Please do not:

• Break any law, or use the app for any unlawful purpose.
• Access, or try to access, another person’s account or data.
• Interfere with, disrupt, overload, or probe the app or its backend, or attempt to get around the paywall, authentication, rate limits, or any other technical restriction.
• Use bots, scrapers, or automated tools against the service.
• Resell, sublicense, rent, or redistribute the app or access to it, or offer it as part of a service to others.
• Reverse engineer, decompile, or disassemble the app, except where that right cannot be waived under applicable law.
• Upload anything malicious, or anything unlawful or infringing.
• Present the app’s output as a clinical assessment, or use it to give medical advice to another person.

One specific request about emergency contacts. The app lets you save an emergency contact’s name and phone number. That person is not an app user and has not agreed to anything. Only enter their details if they have agreed to be listed, and only enter what is needed. The same applies to anything you type into a note about another person — a doctor, a family member, a caregiver.

8. Intellectual property

The app itself — its code, design, interface, graphics, text, icons, and educational content — is owned by us and protected by copyright, trademark, and other intellectual property laws. Your data is yours; the app is ours.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in line with these Terms and with Apple’s App Store Terms of Service, for as long as your subscription or trial is active.

You may not copy, modify, distribute, publish, or create derivative works from the app, use it for a commercial purpose without written permission, or remove any copyright or trademark notice.

“AFib Companion” and “My AFib Companion” are our names for this app. Apple, App Store, Apple Watch, HealthKit, Face ID, and Touch ID are trademarks of Apple Inc. Other names mentioned belong to their owners, and mentioning them does not imply any endorsement of this app.

9. Apple and other third parties

9.1 Apple

Your licence to use the app is granted by us, not by Apple, and Apple is not a party to these Terms. Apple has no responsibility for the app or its content and no obligation to provide any support or maintenance for it. If the app fails to conform to any applicable warranty, you may tell Apple, and Apple will refund the purchase price if it decides to; beyond that, Apple has no other warranty obligation whatsoever. Any claim relating to the app — including product liability, a failure to meet a legal requirement, or a consumer protection claim — is our responsibility and not Apple’s, as between you and Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You must comply with Apple’s App Store Terms of Service, and you confirm you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and are not on any U.S. Government restricted-parties list.

9.2 Other services the app depends on

Running the app requires a few outside services: Apple (App Store, payments, HealthKit), Supabase (authentication and hosting for your synced records), and RevenueCat (which tells the app whether your subscription is active, and receives an account identifier — not your health data). Each has its own terms and privacy policy. Their availability is outside our control, and an outage at any of them may interrupt the app.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, AFib Companion is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• the app will be uninterrupted, timely, secure, or error-free;
• defects will be corrected;
• data will never be lost, delayed, or corrupted;
• notifications and reminders will be delivered on time, or at all;
• readings sourced from Apple Health will be complete or accurate; or
• any summary, correlation, trend, adherence figure, calculator output, report, or educational item the app produces will be accurate, complete, or useful.

Nothing in the app is a medical finding, and no output from it should be treated as one. See Section 3.

No advice or information, whether spoken or written, obtained from us or through the app, creates any warranty not expressly stated here.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Where a warranty cannot lawfully be excluded, it is limited to the shortest period allowed by law.

11. Limitation of liability

To the maximum extent permitted by applicable law:

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or connected with your use of — or inability to use — the app. This applies even if we have been advised that such damages are possible.

We are not liable for any decision you or anyone else makes about health, medications, or treatment on the basis of anything the app shows, for any missed or mistimed medication, for any delay in seeking medical care, or for any reliance on the app during an emergency.

Our total liability for all claims arising out of or relating to the app or these Terms will not exceed the total amount you actually paid for the app in the twelve (12) months before the event giving rise to the claim. If you paid nothing during that period, our total liability is limited to $50 USD.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

These limits apply regardless of the legal theory — contract, tort, negligence, strict liability, statute, or anything else.

12. Indemnity

You agree to indemnify, defend, and hold harmless the developer of AFib Companion from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or connected with:

• your use or misuse of the app;
• your breach of these Terms;
• your violation of any law or of anyone else’s rights, including information you entered about another person, such as an emergency contact; or
• any decision made by you or by a third party on the basis of information from the app.

We may take over the defence of any matter subject to this indemnity, at your expense, and you agree to cooperate with us if we do.

13. Termination

You can leave at any time. Cancel your subscription through Apple, delete your account in the app, and delete the app from your device. You do not need a reason and you do not need to tell us.

We may suspend or end your access if you breach these Terms, if we are required to by law, if your use puts the service or other users at risk, or if we discontinue the app. Except where a breach or a legal requirement makes it impossible, we will give reasonable notice by email before ending access, and we will keep the CSV export route open so you can retrieve your records.

If we discontinue the app, we will give as much advance notice as we reasonably can, stop charging new subscription periods, and leave export available during the notice period.

On termination, your right to use the app ends immediately. Your data is handled as described in the Privacy Policy. These sections survive termination: 6.1 (ownership), 8, 10, 11, 12, 15, and 16 — along with anything else that by its nature should continue.

Ending your access does not automatically cancel your App Store subscription. Cancel that through Apple.

14. Changes to these Terms

We may update these Terms. When a change is material, we will update the “Last updated” date at the top and notify you in the app or by email before the change takes effect.

Continuing to use AFib Companion after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the app — and cancel your subscription through Apple and delete your account if you wish.

15. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee and the United States, without regard to conflict-of-law rules.

Talk to us first. If something goes wrong, email [email protected] and describe the problem. Most things can be sorted out this way, and both sides agree to try informal resolution for 30 days before starting anything formal.

If that fails. Any dispute that cannot be resolved informally within 30 days will be settled by binding arbitration on an individual basis, under the rules of a recognised arbitration provider, seated in Tennessee or conducted remotely. Judgment on the award may be entered in any court with jurisdiction.

Individual basis only. You and we each agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding.

Exceptions. Either of us may bring a claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or stop unauthorised access to the service.

If you are a consumer, nothing here removes any right you have under the mandatory consumer protection laws of the place you live, including any right to bring a claim in your local courts.

16. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the app, and replace any earlier understanding.

Severability. If any part of these Terms is held unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force.

No waiver. If we do not enforce a provision straight away, that is not a waiver of it.

Assignment. You may not assign or transfer these Terms. We may assign them in connection with a transfer of the app, provided your rights are not reduced.

Force majeure. We are not liable for failures caused by events outside our reasonable control, including outages at Apple, Supabase, or RevenueCat, network failures, or acts of government.

Headings are for convenience and do not affect interpretation.
